The Utah Supreme Court has final authority of interpretation of the Utah Constitution. The Utah Supreme Court is composed of five members: a Chief justice, an Associate Chief Justice, and three Justices. All Justices are appointed by the Governor, and require confirmation by the Utah Senate. The Justices vote amongst themselves for the Chief Justice and Associate Chief Justice positions, who each serve a term of four years.

"The Judicial Article of the Utah Constitution, revised effective July 1, 1985, establishes merit selection as the exclusive method of choosing a state court judge. As stated in the Utah Constitution: 'Selection of judges shall be based solely upon consideration of fitness for office without regard to any partisan political consideration.'"[1]
